ExomeDNA Service-Specific Terms

Effective Date: April 2026. These terms supplement the General Terms of Service below and are incorporated by reference.

1. Service Description

ExomeDNA is an educational genetic interpretation platform. You upload a genetic data file previously obtained from a consumer DNA testing service (such as 23andMe or AncestryDNA), and ExomeDNA analyzes that file against published genome-wide association studies (GWAS) and peer-reviewed scientific literature to generate personalized educational trait reports.

ExomeDNA does not perform DNA sequencing, genotyping, or any form of laboratory testing. ExomeDNA has not been cleared or approved by the U.S. Food and Drug Administration and is not intended to diagnose, treat, cure, or prevent any disease. It does not provide medical advice, diagnosis, prognosis, or treatment recommendations.

2. Eligibility

You must be at least 18 years old to create an account and use ExomeDNA. By creating an account and uploading genetic data, you represent that you are at least 18 years of age. You may only upload genetic data files that belong to you or for which you have legal authority to consent to processing.

3. Service Tiers and Pricing

All prices are in U.S. dollars. Unless otherwise stated, all purchases are one-time payments, not recurring subscriptions.

3.1 Free Tier — Identity Deck

  • Up to 10 monogenic (single-gene) trait cards
  • Shareable card format
  • No AI Health Coach access
  • No payment required

3.2 Minimum Tier — $50

  • One (1) trait category bundle selected from four options:
    • Performance: Fitness & Body + Nutrition & Diet
    • Wellness: Brain & Mental Health + Drug & Medication Response + Reproductive & Sexual Health
    • Vitals: Cardiovascular Health + Metabolism & Hormones
    • Longevity: Cancer-Related Trait Research + Immune & Autoimmune + Longevity & Aging
  • AI Health Coach access scoped to purchased bundle categories

3.3 Full Report — $199

  • All trait categories across all 10 domains
  • Unrestricted AI Health Coach access

3.4 Family Plan — $299

  • Two (2) Full Report accounts
  • Each account has independent access and independent consent requirements
  • The second account must be activated within 12 months of purchase

3.5 Upgrade — $150

  • Minimum Tier users may upgrade to Full Report for $150
  • Previously purchased categories carry over

3.6 AI Credit Top-Ups

  • Additional AI Health Coach credits may be available for separate purchase
  • Credits are non-transferable and non-refundable
  • Pricing and availability to be announced

4. Payments

Payments are processed by Stripe, Inc. ExomeDNA does not store full credit card numbers or CVV codes. Prices may change; changes apply only to new purchases.

5. Refund Policy

Before processing: Full refund within 30 days if no DNA file has been uploaded.

After processing: Refunds are generally not available once trait results have been generated because the digital service has been fully performed.

Exceptions: ExomeDNA may offer refunds for technical failures that prevented results, duplicate charges, or unauthorized transactions.

Family Plan: If only one of two accounts has been activated, a partial refund of $149 may be requested within 30 days.

6. AI Health Coach

6.1 The AI Health Coach is an educational tool powered by artificial intelligence. It is not a licensed healthcare professional and does not provide medical advice, diagnosis, or treatment recommendations.

6.2 Use of the AI Health Coach requires separate consent, provided through a standalone authorization screen in compliance with the Illinois Genetic Information Privacy Act (410 ILCS 513).

6.3 When you use the AI Health Coach, ExomeDNA transmits trait-level data (trait names, scores, confidence ratings, educational summaries) to Anthropic, PBC under a Zero Data Retention (ZDR) arrangement. The ZDR arrangement prohibits retention of ExomeDNA request data and prohibits its use for model training. Gene names, rsID identifiers, genotype values, raw DNA data, and personally identifying information are never sent. See the Privacy Policy for details.

6.4 The AI Health Coach may decline to answer questions requiring clinical judgment, specific medication recommendations, or diagnostic conclusions.

7. Genetic Data Handling

7.1 Your raw genetic data file is processed entirely in working memory (RAM) and is permanently destroyed upon completion of analysis. It is never written to disk, stored in a database, or retained in any form.

7.2 Only derived trait-level results (scores, percentiles, categories, confidence ratings, educational summaries) are stored in your account. These do not contain gene names, rsID identifiers, or genotype values.

7.3 You may request deletion of all your data at any time from Settings > Privacy. Deletion is irreversible and will be confirmed within 30 days.

7.4 ExomeDNA does not sell, license, or rent your genetic data or derived results to any third party.

8. Disclaimers

8.1 ExomeDNA makes no claims regarding the accuracy, completeness, or applicability of its analysis for any individual. Results reflect statistical associations from published research and may not apply to your individual circumstances.

8.2 Services are provided "as is" and "as available." No warranties, express or implied, regarding accuracy, reliability, or fitness for any particular purpose.

8.3 The federal Genetic Information Nondiscrimination Act (GINA) generally protects against genetic discrimination in health insurance and employment. GINA does not cover life insurance, disability insurance, or long-term care insurance.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ExomeDNA's total liability for any claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid to ExomeDNA in the 12 months preceding the claim, or (b) fifty U.S. dollars ($50 USD).

For claims arising directly from unauthorized access to or disclosure of your genetic data or derived trait results caused by ExomeDNA's failure to implement reasonable security measures, ExomeDNA's total aggregate liability shall not exceed twenty-five thousand U.S. dollars ($25,000 USD) per individual claimant, and shall not exceed five hundred thousand U.S. dollars ($500,000 USD) in the aggregate across all claims arising from the same incident or series of related incidents.

Nothing in this Section limits ExomeDNA's liability for gross negligence, willful misconduct, or intentional fraud.

ExomeDNA shall not be liable for damages arising from your voluntary disclosure of your results to third parties, or unauthorized access to your account resulting from your compromised credentials or failure to maintain account security.

The limitations of liability in this Section shall survive termination or expiration of these Terms.

10. Disputes, Arbitration, and Class Action Waiver

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

BINDING ARBITRATION: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in English in the State of Texas, or at a mutually agreed location, or remotely if both parties consent. The arbitrator's decision shall be final and binding. AAA rules are available at adr.org or by calling 1-800-778-7879.

SMALL CLAIMS EXCEPTION: Either party may bring an individual claim in small claims court for disputes within that court's jurisdiction, provided the claim remains in small claims court and is not removed or appealed to a court of general jurisdiction.

CLASS ACTION WAIVER: YOU AGREE TO RESOLVE ANY DISPUTE WITH EXOMEDNA ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING.

If this class action waiver is found unenforceable for a particular claim, that claim shall be litigated in court and all other claims shall remain in individual arbitration.

JURY TRIAL WAIVER: If for any reason a claim proceeds in court rather than arbitration, YOU AND EXOMEDNA EACH WAIVE ANY RIGHT TO A JURY TRIAL.

MASS ARBITRATION: If more than 25 similar arbitration demands against ExomeDNA are filed within any 180-day period by the same or coordinated counsel, the AAA shall administer them as a batch process with common discovery and briefing schedules, but with separate individual hearings and separate awards for each claimant.

FILING DEADLINE: Any claim must be filed within one year of the date you first knew or reasonably should have known of the act or omission giving rise to the claim, or such claim is permanently waived.

11. Changes

Material changes to these terms will be communicated via email at least 30 days before taking effect. For material changes to how ExomeDNA processes genetic data or shares data with third parties, we will request your renewed consent before the change takes effect. For other material changes, continued use of ExomeDNA after the effective date constitutes acceptance of the updated terms.
